In a series of rather stunning responses to questions from Senators at his confirmation hearing today, Supreme Court nominee Samuel Alito defended his decision in a key public health and water pollution case to dismiss the lawsuit brought by citizens to clean up pollution in the Delaware River.
"Unless people can prove they are sick from drinking the water, citizens are going to have a tough time protecting waters that they use and care about from industrial pollution if Alito is confirmed," said Joan Mulhern, senior legislative counsel at Earthjustice and clean water advocate. "Effectively, what Judge Alito is saying is: don't drink the water."
Mulhern noted that Judge Alito's position on this case relates directly to two cases currently under consideration by the U.S. Supreme Court in which, if confirmed, he could determine the outcome. In these cases, developers and polluters are arguing that tributaries of larger "navigable" waters, like the Delaware River, should have no Clean Water Act protections at all, even if pollution from these smaller streams and rivers eventually flows down into the larger river.

"Unfortunately for the American public, Judge Alito's comments indicate that he appears to share polluters' disregard for the simple fact that waters flow downstream," added Mulhern.

I had been scheduled to testify as an expert on an organization called Concerned Alumni of Princeton. In 1985, on an application for a promotion in the Reagan Justice Department, Alito had touted his membership in CAP, which had opposed coeducation at Princeton and asked for strict quotas limiting the numbers of women and minorities at the university. Alito's membership in the group thus could shed light on his respect for civil rights.
Bill Bradley (Princeton, class of 1965), future Democratic senator, quit CAP in disgust within a year after it was founded in 1972. Bill Frist (class of '74), future Republican Senate majority leader, publicly censured the organization. But CAP survived to become more anti-woman and anti-minority. In 1984, a year before Alito proudly proclaimed his membership, CAP's magazine had published details of an underage female student's sex life and named her, allegedly by mistake. A few issues before that, in a piece about blacks and Latinos, the magazine editorialized: "People nowadays just don't seem to know their place."

President Bush, he said, "has seized unilateral executive powers;" having Alito on the High Court is a major threat to Americans' civil liberties as a result.
Romero cited Alito's troubling decisions on race, religion, and reproductive rights during his years as a federal appeals court judge. What concerns the ACLU and Democrats everywhere is that these are the key issues where O'Connor provided the crucial swing vote.
Alito has a frightening 15-year paper trail which the ACLU has meticulously detailed in a issued a 68-page report. This documentation of Alito's record on civil liberties and civil rights was sent in December, along with a letter expressing "deep concern," to Senate Judiciary Committee Chairman Arlen Specter and Ranking Member Patrick Leahy, urging the committee to conduct a thorough review of Judge Alito's record.

Back in 1990, Senate Democrats roped McCain into the scandal over savings and loan kingpin Charles Keating on tenuous grounds, just so not all the senators involved would be Democrats.
The GOP now craves such bipartisan cover in the Jack Abramoff scandal. Republicans trumpet every Democratic connection to Abramoff in the hope that something resonates. Senate Minority Leader Harry Reid (D., Nev.), took more than $60,000 from Abramoff clients! North Dakota Democratic Sen. Byron Dorgan used Abramoff's skybox! It is true that any Washington influence peddler is going to spread cash and favors as widely as possible, and 210 members of Congress have received Abramoff-connected dollars. But this is, in its essence, a Republican scandal, and any attempt to portray it otherwise is a misdirection.

The Republican party, the party of original intent, is letting George Bush expand his presidential power in direct opposition to the intent of the framers of the Constitution.
For better or worse, though, this is not the system envisioned by the framers of the Constitution. The framers meant for the legislative branch to be the most important actor in the federal government: Congress was to make the laws and the president was empowered only to execute them. The very essence of a republic was that it would be governed through a deliberative legislature, composed carefully to reflect both popular will and elite limits on that will. The framers would no sooner have been governed by a democratically elected president than by a king who got his job through royal succession.
For the last four years, a Republican Congress has done almost nothing to rein in the expansion of presidential power. This abdication of responsibility has been even more remarkable than the president's assumption of new powers.

Abramoff's team didn't neglect party politics either: There were at least two meetings with Republican National Committee officials, including then-finance chief Jack Oliver, as well as attendance at GOP fundraisers.
In 2000, Abramoff and his team were connected enough to both political parties to boast of obtaining early drafts of the platforms each adopted at its presidential nominating convention.
"In the case of the Republican platform, the team reviewed and commented on sections dealing with insular territories to ensure appropriately positive treatment. This was successful," the Preston Gates firm wrote to Marianas.
"In the case of the Democratic Party platform, the team assisted in drafting early versions of neutral language relating to the territories," the firm wrote. "However, heavy intervention by the White House eventually deleted positive references to the CNMI."
The access of Abramoff and his team to the administration came as the lobbyist was establishing himself as a GOP fundraiser.

Insisting that God "certainly needs to be involved" in the Supreme Court confirmation process, three Christian (sic) ministers today blessed the doors of the hearing room where Senate Judiciary Committee members will begin considering the nomination of Judge Samuel Alito on Monday.
Capitol Hill police barred them from entering the room to continue what they called a consecration service. But in a bit of one-upsmanship, the three announced that they had let themselves in a day earlier, touching holy oil to the seats where Judge Alito, the senators, witnesses, Senate staffers and the press will sit, and praying for each of the 13 committee members by name.
"We did adequately apply oil to all the seats," said the Rev. Rob Schenck, who identified himself as an evangelical Christian (sic) and as president of the National Clergy Council in Washington.
Rev. Schenck called the consecration service the kick-off in a series of prayer (sic) meetings that will continue throughout the confirmation hearing.
Capitol Hill police said they weren't aware that the three had entered the hearing room earlier, but added that hearing rooms typically aren't locked because "they're not of interest to anyone." Lt. Dominick Costa said the Judiciary Committee room will be swept for bombs and perhaps for electronic bugging equipment before the hearing begins.
The three ministers insisted they weren't taking sides in the Alito debate. "This is not a pro-Alito prayer," insisted the Rev. (sic) Patrick Mahoney, director of the Christian (sic) Defense Coalition. With abortion, public prayer, gay marriage and right-to-life issues among those topping public debate, however, "God…is interested in what goes on" in the nomination hearing, Rev. Schenck said.
